Ethical and Legal Issues in Consultation

Timothy E. Heron

Timothy E. Heron, EdD, is professor of educational services and research at The Ohio State University. His teaching and research interests include consultation, tutoring systems, applied behavior analysis, spelling instruction, and parent training.

Stacy A. Martz

Stacy A. Martz, PhD, is director of the St. Joseph's Home, a family-oriented group facility for women with developmental disabilities in Westerville, Ohio. Her research and scholarship interests focus on choice making, consultation, and applied behavior analysis.

Howard Margolis

Howard Margolis, EdD, is professor of educational and community programs at Queens College of CUNY. He specializes in conflict resolution, applied behavior analysis, and reading difficulties. This article discusses the nature of ethics and addresses many of the complex ethical and legal issues that challenge consultants daily. It offers a framework for making sound ethical and legal decisions that serve students effectively. Critical legal concepts, such as least restrictive environment and free appropriate public education, are discussed. Finally, practical suggestions are offered for avoiding common ethical and legal pitfalls.
